The organization shall be known as the Academic Senate of San Joaquin Delta Community College (hereinafter referred to as the Senate).听
Academic Senate Bylaws
In accordance Title V, Section 53200-53205, California Administrative Code, the Senate shall be the recognized representative of the faculty to the administration and governing board of San Joaquin Delta Community College concerning academic and professional matters and shall participate in the formation and revision of District policies and procedures in all matters of an academic and professional nature.
The electorate for full-time faculty shall be composed of those certificated employees who teach full-time and other full-time certificated employees who do not perform any administrative supervisory duties for the college, including partial retirees. Full-time faculty and partial retirees shall be defined as per SJDCTA Contract.
The electorate for Part-time Associate Professor faculty shall be composed of those certificated employees who meet the definition of 鈥渁djunct鈥 as specified in district policy, SJDCTA Contract, and who do not perform any administrative supervisory duties for the college.听
Section 1. The following shall make up the membership of the Senate: 听
Clause 1. All elected and appointed officers and senators shall be faculty members who do not perform any administrative supervisory duties for the college.
Clause 2. A minimum of one tenured or tenure-track member from each defined academic unit per Bylaws: Agriculture; Arts and Multimedia; Business and Law; Communications and Languages; Health and Fitness; Science, Engineering, Computer Science, and Math; Social Sciences, Education, and Public Service; Technical Careers and Trades; Counseling and Special Services; and Library Services.
An academic unit shall be entitled to a second Senate seat when the number of tenured or tenure-track full-time faculty members reaches sixteen at the beginning of the Spring semester. A third Senate seat shall be allocated when the number of tenured or tenure-track full-time faculty members in an academic unit reaches thirty-one at the beginning of the Spring semester. A fourth Senate seat shall be allocated when the number of tenured or tenure-track full-time faculty members in an academic unit reaches forty-six at the beginning of the Spring semester. A fifth Senate seat shall be allocated when the number of tenured or tenure-track full-time faculty members in an academic unit reaches sixty-one at the beginning of the Spring semester.听

Clause 3. The President of the SJDCTA, ex-officio, non-voting.
Clause 4. The President of the Associated Students of Delta College or designee, ex-officio, non-voting.
Clause 5. Any SJDC faculty member elected as an officer of the Academic Senate for California Community Colleges (ASCCC), ex-officio, non-voting.
Clause 6. Five representatives of the Part-time faculty.
Section 2. Senate members shall serve terms of two years, with one-half of the members being replaced each year. Senators may be re-elected.
Section 3. Attendance Policy
Clause 1. Senators are expected to attend all regularly scheduled meetings of the Academic Senate.
Clause 2. In the event that a Senator is unable to attend a meeting of the Academic Senate, they may designate a proxy member to attend in their place. A designated proxy member must be a faculty member who does not perform any administrative supervisory duties for the college and must represent the same constituency as the absent Senator. A proxy may not be used for more than two meetings in one semester, not to exceed five meetings total during a Senator's two-year term. A Senator shall be deemed present represented by a valid proxy.
Clause 3. A senator may lose their seat in the Academic Senate if they are absent for three consecutive meetings, or a total of five meetings over a two-year period, for which they have not designated a proxy. In the event that a Senator loses their seat, the Executive Board will appoint an interim Senator to represent the vacant seat鈥檚 constituency to serve for the remainder of the semester, at the end of which a special election will be held. The new Senator will complete the unexpired term of the Senator they are replacing.
Clause 4. The Senate seat of a Part-time Associate Professor Faculty member shall be declared vacant at the time when the elected representative is no longer teaching Part-time Associate Professor Faculty member load within a school year. The Executive Board will appoint Part-time Associate Professor Faculty member to complete the unexpired term of the Senator they are replacing.
Clause 5. Should a Senator be unable to attend Senate meetings because of a conflicting situation, the member may request in writing to the Executive Board that it appoint an interim Senator from the same academic unit to serve the duration of the special situation. It shall be up to the Executive Board to accept or reject the request and to fill or leave vacant the senatorial seat in question. Such requests must be made prior to reaching the maximum absences permitted by a Senate member under these bylaws.
Clause 6. Should a Senator be unable to complete their term for any reason, the Executive Board will appoint an interim Senator to represent the vacant seat鈥檚 constituency to serve for the remainder of the semester, at the end of which a special election will be held. The new Senator will complete the unexpired term of the Senator they are replacing.
Section 1.听 The officers of the Academic Senate shall be a President, a First Vice President, a Second Vice President, a Vice President of Curriculum, a Vice President of Social Justice and Equity, and a Vice President of Part-time Associate Professor Faculty, defined as members of the Executive Board in Article VII. The officers of the Academic Senate shall be selected from the tenured or tenure-track full-time faculty as defined in Article III, excepting for the Vice President of Part-time Associate Professor Faculty, who shall be selected from among the Part-time Associate Professor faculty as defined in Article III. These officers shall perform the duties as prescribed by these bylaws and by the parliamentary authority adopted by the Senate. Release time for each officer shall be negotiated through the SJDCTA and be written in the SJDCTA contract.
Clause 1. No Officer serving as an Executive Board member for the Academic Senate may hold an Executive Board Officer position in the SJDCTA concurrently. 听

Section 2. The President of the Senate shall:
Clause 1. Preside at all meetings of the Senate, using the accepted parliamentary authority.听
Clause 2. Represent the faculty at official college functions in person or by appointed representative.听
Clause 3. Represent the faculty at meetings of the college governing board in person or by appointed representative.听
Clause 4. Be an ex-officio, non-voting member of all Senate committees.
Clause 5. Direct the overall operation of the Senate and approve time cards of non-Classified office staff.
Clause 6. Represent the Senate as the official voting delegate, in person or by proxy, at all meetings of the Academic Senate for California Community Colleges.听
Clause 7. Represent the Senate at meetings of the President's Council and Cabinet and other such administrative or district-wide meetings relating to the operation of the Senate in person or by appointed representative.
Clause 8. Meet on a regular basis with the President and the Vice Presidents of the College to discuss academic and professional concerns.
Clause 9. Carry out all directives of the Senate and serve as the Chairperson of the Executive Board.
Clause 10. Serve as, or appoint, the official delegate from the faculty to the Community College League of California (CCLC).
Clause 11. Be responsible, in consultation with the Flex Coordinator, for final notification to faculty of failure to meet flex responsibilities.
Clause 12. Be replaced by the First Vice President for the remainder of the term of office in the event that the office of the President becomes vacant. In the event that the First Vice President cannot take over the role of President, the Second Vice President will take on the role for the remainder of the term of office. If neither the First nor Second Vice President can take on the role, Senate will hold a special election for an Interim President of the Academic Senate to serve for the remainder of the term of office.
Section 3. The First Vice President shall:
Clause 1. Act in the place of the President in the event of their absence.
Clause 2. Succeed and fulfill the office of President for the remainder of the unexpired term in the event that the President is unable to complete their term.
Clause 3. Act as Chairperson of the Faculty Professional Growth Committee and recommend to the floor of the Senate action on such items as approved by that committee.
Clause 4. In the event that the Academic Senate Administrative Assistant is not in attendance, be responsible for maintaining attendance records of the Senate.
Clause 5. Assist the President in representing the Senate at meetings of the President鈥檚 Council and Cabinet and other such administrative meetings relating to the operation of the Senate.
Clause 6. Perform such functions and duties as directed by the President or the Executive Board.
Clause 7. 听Will conduct and coordinate all regular and special elections, except for elections that include the position of First Vice President. 听The Second Vice President will oversee the elections when the First Vice President is included on the ballot.听

Section 4. The Second Vice President shall:
Clause 1. Act in place of the President when the First Vice President is not available.
Clause 2. Act as Senate representative for the Policies and Procedures Committee, the Entitlement Process and Program Review.
Clause 3. When the Senate calls for a subcommittee or workgroup, then the second vice president will be responsible for appointments and ensuring that the Chair establishes a meeting calendar.
Clause 4. Perform such functions and duties as directed by the President or the Executive Board.
Section 5. Vice President of Part-time Associate Professor Faculty shall:
Clause 1. Represent the interests of Part-time Associate Professor faculty to the Senate Executive Board.
Clause 2. Communicate regularly with Part-time Associate Professor faculty to determine their needs and to discuss items before the Senate.
Clause 4. Perform such functions and duties as directed by the President or the Executive Board.
Section 6. The Vice President of Curriculum shall:听
Clause 1. Act as Chairperson of the Curriculum Committee and recommend to the floor of the Senate for such actions and items as approved by that committee.
Clause 2. Provide guidance on goals and objectives to the curriculum sub-committees and workgroups.
Clause 3: Attend the ASCCC Curriculum Institute, ASCCC Curriculum Regionals, and other statewide meetings.
Clause 4: Participate in curriculum technical review.
Clause 5. Perform such functions and duties as directed by the President or the Executive Board.
Section 7. The Vice President of Social Justice and Equity shall:
Clause 1. Represent the interests of inclusion, diversity, equity, antiracism, accessibility (IDEAA), and social justice, and the intersectionality of these principles.鈥
Clause 2. Organize, advocate, advise, educate, develop policies and programs, and participate in professional development in order to advance the goals, objectives, and guiding principles of the ASCCC鈥檚 IDEAA Framework, SJDC鈥檚 equity work, and social justice.鈥
Clause 3. Develop yearly IDEAA and social justice goals and evaluate progress on those goals on an annual basis.
Clause 4. Coordinate communication to the Senate and campus community around IDEAA and social justice efforts, goals, reports, and news.
Clause 5. Serve as a liaison to the ASCCC鈥檚 Equity and Diversity Action Committee, an ex officio member of the Curriculum Committee, and a member of the Student Success and Equity Committee.
Section 1. Officers and Senators may be removed from office by a 2/3 vote of the Academic Senate.
Section 2. Should an Officer or Senator be removed from their position, the Executive Board will appoint an interim Officer or Senator to serve for the remainder of the semester, as per these bylaws, at the end of which a special election will be held. The new Officer or Senator will complete the unexpired term of the Officer or Senator they are replacing.
听
Section 1. Election of members of the Senate shall take place during the spring semester of each year.
Clause 1. Upon the expiration of a regular Senate term, the First Vice President of the Senate shall conduct an election in the academic unit for the purpose of filling the vacant seat. Election shall be by majority vote.
Clause 2. A new Senate representative will not be seated until a valid election has been held and the ballots from the election are certified by the Executive Board.
Clause 3. At the direction of the Executive Board, special elections shall be conducted by the First Vice President of the Senate.
Clause 4. In a semester when tenured or tenure-track full time faculty senator seats are up for re-election and a pending reorganization that affects senate representation is in progress, a special election may be held after the reorganization is complete. The current tenured or tenure-track full-time senators will remain in office until the special election is completed.听
Clause 5. The election results shall be reported individually to the candidates and to the faculty at large, by the Vice President who conducted the election, within ten working days.
Section 2. The President, First Vice President, Second Vice President, and Vice President of Curriculum, and Vice President of Social Justice and Equity shall be elected by a majority vote of the ballots cast by all of the faculty, as defined in Article III, to serve a two-year term. The Vice President - Part-time Associate Professor Faculty shall be elected by a majority vote of the ballots cast by the Part-time Associate Professor faculty, as defined in Article III, to serve a two-year term. A run-off election of the top two candidates will be held if no candidate receives a majority of the vote.
The election of the First Vice President, Vice President of Curriculum, and Vice President of Part-time Associate Professor Faculty shall happen on odd years and the President, and Second Vice President, and Vice President of Social Justice and Equity positions shall happen on even years.
Section 1. The Officers of the Senate shall constitute the voting members of the Executive Board. The Immediate Past President and the Immediate Past Curriculum Chair, providing they are tenured or tenure-track full-time faculty members, shall serve as ex-officio, non-voting members for the first year immediately following their terms. The SJDCTA President, or a designee, and the Senate Parliamentarian, and any 九色视频 faculty member elected as an officer of the Statewide Academic Senate, shall serve as ex-officio, non-voting members of the Executive Board.
Section 2. The Executive Board shall have general supervision of the affairs of the Senate between its business meetings, fix the hour and place of meetings, make recommendations to the Senate, and perform other duties as specified in the Bylaws. The Board shall be subject to the orders of the Senate and none of its acts shall conflict with any action taken by the Senate.听
Section 3. An Academic Senate officer may make agreements with the Administration of 九色视频 on behalf of the Academic Senate only when authorized by the Academic Senate, under terms and conditions specified by the Academic Senate. Under circumstances deemed by the Academic Senate President to be sufficiently compelling, tentative agreements with the Administration of 九色视频 District may be made without initial authorization, subject to report to and ratification by the Academic Senate at a regular or special meeting.
Section 4. The Executive Board may hold regular post-senate meetings with the President and the Vice Presidents of the college to discuss academic and professional concerns.听
Section 5. All members of the Executive Board shall write goals and objectives and an End of Year Report for each academic year.
Section 1. A parliamentarian shall be appointed by the President at the beginning of each college year.
Section 2. The Senate shall meet as scheduled in the official college calendar. Notice of all Senate Meetings will be posted in accordance with the Brown Act.
Section 3. A simple majority of the Senate shall be considered a quorum.
Section 4. Items may be placed on the agenda of the Senate by any Senator or by faculty members through their Senators. All other agenda items must be approved by the President of the Senate.
Section 5. Senate meetings are open to all members of the electorate, and to non-members, but only members of the Senate possess a vote. Visitors may speak either at the time designated as comments from the public or on an action item at the time of discussion of the item. The speaker shall be limited to five minutes per item unless extended by the chair.
Section 6. All minutes and agendas will be posted on the Academic Senate Website and to the public display which is available to the college community.听
Section 7. Special meetings of the Senate may be called at the discretion of the President or when requested in writing by five members of the Senate with appropriate notification per the Brown Act.
Section 8. In all matters of internal functioning not covered by these Bylaws, the Senate shall be governed by Robert's Rules of Order, latest revised edition.
Section 9. The Senate shall route requests for necessary clerical, budgetary, and other requirements to the Board of Trustees through regular channels.
Section 10. The Senate shall present its views and recommendations to the Administration and Board of Trustees on matters concerning, but not restricted to, the following:
Clause 1. Matters involving the educational program of the college, including program review, the regular day, evening, and all sessions, curricula, institutional framework and processes related to Student Learning Outcomes and Assessments, and matriculation standards, changes in courses of study, requirements for degrees and diplomas, and all 10 +1 areas of Academic Senate primacy as referenced in AB 1725.
Clause 2. Policy regarding appointments, status, and selection of teaching faculty members and administrative staff.
Clause 3. Policy for the establishment and discontinuance of 九色视频s, programs, departments, and administrative positions.
Clause 4. General policy regarding student affairs and activities.听
Section 1. All college-wide faculty committee appointments shall be made by the Academic Senate President in consultation with the Executive Board. 听 听
Section 2. Committee members shall be limited to two consecutive appointed two-year terms on any one committee. Except for the Curriculum Committee which shall be limited to three terms.
Section 3. All members of standing, special, and ad hoc committees, including the Curriculum, Distance Education, Faculty Professional Growth, and General Education Committees of the Senate will be appointed by the Academic Senate Second Vice President.
Section 4. All committee Chairs shall write goals and objectives and an End of Year report for each academic year, for presentation to the Academic Senate.听
Section 5. The Senate Standing Committee on Curriculum shall consist of the Vice President of Curriculum as its chairperson and six faculty members (two from 听career technical education, two from general education, one librarian and one counselor preferable, with no more than one member from any 九色视频), the Chair of the Distance Education 听Committee, the Student Learning Outcomes Coordinator, Assistant Superintendent/Vice President of Instruction and Planning, the Dean of Student Learning and Assessment and the Articulation Officer. 听The Curriculum Support Coordinator and a student appointed by the Associated Students of Delta College shall be non-voting ex-officio members of this committee. The Assistant Superintendent/Vice President of Instruction and Planning shall be a non-voting ex-officio member.听
This committee will be charged with the responsibility of reviewing curriculum related items to be presented for consideration at Senate meetings.听
Section 6. The Distance Education Committee, as a standing committee advisory to the Curriculum Committee, shall consist of a chairperson, the Dean of Regional & Distance Education, and one faculty member from each 九色视频, in addition to one counselor, one librarian, and a faculty member specializing in Assistive Technology/Accessibility , all appointed by the 听Second Vice President. The Dean Regional & Distance Education, the Professional Development & Education Coordinator, and the Academic Senate Staff Assistant shall be ex-officio non-voting members of this committee.
The Chairperson shall be a member of the Curriculum Committee and of the Technical Review team, and shall advise the Curriculum Committee as to compliance of new and revised course proposals with Distance Education standards. 听
This committee will be charged with the responsibility to develop, recommend, and review distance education policy and procedure items, best practices, standards and training to be presented to the Academic Senate.听
Section 7. The Open Educational Resources (OER) Committee members include the ASCCC OER Initiative Liaison, the Delta College OER Librarian, and at least 3 additional faculty from three different 九色视频s, the Assistive Technology instructor, and the Distance Education Chair. Ex-officio non-voting members include the Dean of Regional & Distance Education Classification, and the Assistant Dean of Outreach, Equity & Student Services.听
The committee is responsible for promoting OER adoption throughout the District, providing guidance to faculty seeking to adopt OER resources, and ensuring opportunities for grant funding are promoted and supported. The Committee is also charged with ensuring District compliance with SB 1359 by tracking current OER usage at the District and reporting data to the Dean of Student Learning and Assessment each semester. Recommendations from this committee will be presented to the various stakeholder groups and Academic Senate.
Section 8. The Senate Committee on Faculty Professional Growth shall consist of the Academic Senate First Vice President, or designee, who shall be the permanent chairperson of the committee five faculty members: three faculty members, including the Flex Coordinator, shall be appointed by the 九色视频 Teachers Association two faculty members shall be appointed by the Academic Senate.听
This committee will be charged with the responsibility of reviewing individual faculty professional growth requests, flex contracts, and other faculty professional growth opportunities as appropriate, authorizing expenditures of Staff Development funds per AB 1725 and recommending faculty Sabbatical proposals for approval by the Senate.听
Section 9. The General Education Committee, as a standing committee advisory to the Curriculum Committee, shall consist of the Articulation Officer as chairperson, a faculty member actively teaching in each general education area, a Counselor, a CTE faculty member, and the Dean of Student Learning and Assessment. The Academic Senate Staff Assistant shall be an ex-officio non-voting member of this committee.
This committee will be charged with the responsibility of reviewing courses proposed for General Education and reviewing any Title 5 revisions related to general education and making recommendations to the Curriculum Committee on any of these issues. The committee is additionally charged with advising faculty pertaining to the development of interdisciplinary studies degrees including review of said degrees for transfer and general education best practices.
Section 10. The Resolutions and Letters Committee will act as a standing committee of the Academic Senate. The committee shall be comprised of three current members of Academic Senate. A member must have at least one-year experience on Academic Senate to serve on the committee. The committee will meet on an as-needed basis. If, for any reason, the standing committee is unable to meet then the Academic Senate Executive Board will act as the resolutions standing-committee.听
The committee will work with interested parties on drafting a resolution and/or letter. The committee will use the same criteria, for effective resolution writing, as the ASCCC. The Academic Senate Executive Board will proofread the resolution before Senate votes on the resolution as an action item. The resolution will then be added to the following Academic Senate Meeting as an action item.
Section 11. The bylaws committee will act as a standing committee of the Academic Senate (AS). The committee shall be comprised of at least two current members of Academic Senate general body and one member of the Executive Board. A member must have at least one-year experience on academic senate to serve on the committee. The committee will meet on an as-needed basis. If, for any reason, the standing committee is unable to meet then the Academic Senate Executive Board will act as the bylaws standing-committee.听
The committee will work with interested parties on drafting a bylaw change. The Academic Senate Executive Board will proofread the bylaws change before Senate discusses the change as a first read.
Section 12. Attendance and use of proxies at committee meetings shall be governed by Article IV, Section 3.
These Bylaws can be amended at any regular meeting of the Senate by a two-thirds vote, provided that the amendment has been submitted in writing at the previous regular meeting.
